The Small Print you are agreeing to when you book

Ordering
Our calendar does fill up quickly so it is best to book well in advance. We recommend for celebration cakes you order at least 12 weeks in advance and for wedding and sculpted cakes at least 24 weeks in advance. If you do have a last minute order give us a call and we will try to make it work if we can.

Booking Fee and Final Payment
To secure a date in our calendar we take a 50% non-refundable booking fee. Final payment is due 6 weeks before your event. We take payment by cash, cheque and bank transfer.

Wedding / Event Insurance
If it is a high value event we recommend that you take out wedding or event insurance. It’s relatively inexpensive and will protect you if something unexpected happens. Of course read the small print for COVID cover!

What Happens if I Cancel or Postpone?
We really hope this doesn’t happen but, as we’ve all discovered, it can. We’ve set out below how we handle this in a way that provides flexibility but also covers our costs as a business.

Voluntary Change of Date / Cancellation:
This is the situation where you choose to move or cancel your date, but it’s not required by a government mandated restriction. This includes if you choose to move your date due to reduced numbers allowed at weddings.

If you choose to move your wedding, but subsequently a government restriction covers your original date, these charges still apply.

Our normal policy is that postponing or cancelling results in the loss of your booking fee. However we do try to be flexible. See below.

Reschedule - 90 days notice or more - Our team are available on your new date - £200 rescheduling fee

OR

90 days notice or more - Our team are NOT available on your new date - Booking Fee retained.

OR

89 days notice or less - Our team are available on your new date - New Booking Fee required*

OR

89 days notice or less - Our team are NOT available on your new date - Lose all monies paid*

Cancellation - 90 days notice or more - Booking Fee retained

or

Cancellation - 89 days notice or less - Lose all monies paid*

Rescheduling will also result in a 5% increase in the cost of your cake to cover increases in costs.

*The reason for these charges is that at 12 weeks out we are highly unlikely to be able to resell the original booked date.

Involuntary Change of Date / Cancellation:

What Happens if Peboryon Cancels or Postpones?
In the highly unlikely situation that we are unable to provide your cake for your event we will either:

  • Seek to find another reputable cake maker to create your cake for you (with your permission)

  • Or provide a full refund.

  • Delivery
    As standard we deliver up to 300 miles and charge 95p per mile up to a maximum of £300. For distances over 300 miles or international delivery we will discuss cost on a cake by cake basis. This will include the cost of a possible overnight stay.

  • Although we always arrange a delivery time with you or your venue. We cannot guarantee this due to traffic/accidents/road closures/breakdowns etc. And so delivery times are a guide only. We will always inform of any delays.

    After receipt of the cake it is your (or your venues) responsibility to make sure the cake is stored at the correct temperature and moved correctly.

  • FInal Product

  • We pride ourselves on delivering your cake, to the specification agreed upon, on time and in perfect condition. In a tiny amount of cases, and due to factors outside of our control (including but not limited to; supply chain issues, unexpected traffic, extreme weather) this may not be possible. Where time and contact details allow, we will advise in advance if we encounter any issues with your order and will seek to remedy it.

  • From time to time, due to ingredient availiability/seasonality/quality, a specific item may not be availiable/able to be used in your cake. whilst we do not foresee this happening, Peboryon reserve the right to subsitute any ingredient or decorative item with another of equal quality so as to not impact on the final delivery time. In this instance, where time and contact details allow, we will advise of this in advance of delivery.

  • We also reserve the right to make design changes when unforeseen circumstances require. And in the event of extreme heat we reserve the right to switch a buttercream finish for something more stable.

  • Storage
    For sponge cakes we will advise you on the shelf life of your cake because it varies dependent on the filling and storage. Fruitcake can keep well for several months.

    Please note that fondant is not designed for refrigeration and condensation may cause colours to run, and any sugarwork to wilt/melt. Before cutting we recommend storage in a cool dry place in the box provided.

Marquees.

You must inform us if you require your cake and/or dessert table to be set up in a marquee. This is because how we finish the cake will need to be adapted.

We do not recommend the cake being set up in the marquee due to the high temperature and humidity that can be reached in marquees. The table etc for set up must be level and not in direct sun. We also recommend not having delivery and set up until closer to the time arranged to cut the cake, so that it’s not sitting out in the heat any longer that necessary.

We will ask you to read and agree to a ‘Marquee Disclaimer’ And we take no responsibility for any damage to the cake if these conditions are not met or we are not told there is a marquee. We also reserve the right to refuse set up in a marquee if we feel the conditions required have not been met.

  • Complaints

  • Complaints are very rare but if they do arise we take them very seriously. If there is a problem with your cake please let us know within 24 hours with an email, outlining the problem to admin@peboryon.com.

    Any refund given for disputes regarding a cake design or production are completely at the discretion of Peboryon and are not automatic. The refund will not exceed the value of the cake. Full refunds (not including the non refundable booking fee) will never be given for a cake that has been consumed regardless of the dispute, as consumption of the cake is viewed as your acceptance that the cake is adequate for the purpose for which it has been supplied.

    All cakes delivered to venues are photographed from different angles to record the cake quality on delivery. After delivery or collection we do not accept any responsibility for loss or damage to the cake or items with the cake such as knives, decorations and stands. If the cake design has been altered by yourself or your venue, then any complaint about design becomes void.

    We also do not accept responsibility for loss, damage, or non-delivery under unavoidable or exceptional circumstances. We do recommend taking out wedding or event insurance which would cover these eventualities. This in no way affects your statutory rights.

  • Design protection and copyright
    We will not copy other cake makers design, but are happy for you to share cakes that you like as inspiration. Any design produced by us for you is, and remains, the intellectual property of Peboryon and should not be replicated by another cake maker without our explicit permission. Designs will not be provided until the booking fee has been paid.

  • Allergies, intolerances and dietary requirements:
    It is the responsibility of the customer to advise and instruct the team at Peboryon regarding any requirements as a result of allergies and intolerances. Discovering guests’ dietary requirements is the responsibility of the customer.

    Please note that the Peboryon kitchen stores ingredients containing gluten, ground nuts and tree nuts, soya products, eggs, butter, milk, cream (dairy), citrus, gelatin, and alcohol. If you or your guests have an allergy, intolerance, or dietary requirement, it is essential that you talk with the Peboryon team about your dietary requirements, and alert your guests to what they are eating.

  • Blank tiers
    Peboryon have the right to substitute blank tiers as and when determined by the team at Peboryon. This may occur if it is deemed that it would be beneficial for either safety, weight, stability, transportation, health and safety of the team, or as a response to extremes of temperature. It is Peboryon’s responsibility to inform appropriate staff at the venue of any changes, and provide serving cakes for cutting to the same number of portions as have been replaced.

  • Confidentiality & Publications.
    From time to time our designs are published, we reserve the right to use any image of a cake made by Peboryon for publication at a later date. If we do this we will not disclose your names, or personal information unless by express consent from you. However we will not release any images if there is an NDA.

    We will not pass on your personal details to any other supplier without your express consent. But we may discuss your cake and design with other suppliers.

  • Photographs & Videography
    As photographs and video are our only permanent record of our work, we reserve the right to take images of the cake as it is being made, finished and set up in the venue. These images are for our portfolio use and may be used on our website, social media platforms and magazine articles. With this too, our confidentiality rules apply as above.

  • Return of hired equipment
    Deposits are taken for all equipment, stands, props and dishes. A named person will be responsible for the return of hired equipment. All equipment must be returned within 3 days of the wedding date (unless alternative arrangements have been agreed prior to wedding in writing) or extra charges may be levied to cover hire costs. Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.

  • Cake stands. If providing you own cake stands they must be fit for purpose. Which means it can take the weight, have no lip or raised edges and be large enough. We reserve the right to refuse to use any stands if we feel they are not fit for purpose.

  • Force Majeure
    No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s control, including, but not limited to, the
    following force majeure events:

    • acts of God;

    • a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms,

      explosions, infestations), epidemic, or pandemic;

    • war, invasion, hostilities (whether war is declared or not), terrorist threats or acts,

      riot or other civil unrest;

    • government order or law;

    • actions, embargoes or blockades in effect on or after the date of this Agreement;

    • action by any governmental authority;

    • national or regional emergency;

    • strikes, labor stoppages or slowdowns or other industrial disturbances; and (i)

      shortage of adequate power or transportation facilities.

      The Impacted Party shall give notice within 7 days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of 180 days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice.

  • Please note that once a booking fee has been paid, you are agreeing to all of the above terms and conditions.
